THE PROJECT

Being an ongoing innovator of new products, Sayfa recognised the importance of IP protection for its business. In particular, patents and designs were identified as key for maintaining its advantage of being first in the marketplace. Sayfa also recognised the importance of branding its products with unique and catchy names, further differentiating its products from those of its competitors.

PROJECT OBJECTIVES

Being at the forefront of research and development of new height access and safety products, Sayfa Systems took cognisance of the vital importance of intellectual property protection.

Design registration and/or innovative patents were accordingly identified as key criteria, for maintaining their cutting-edge technology advantage in the marketplace.

Furthermore product branding was recognised as sound business strategy, and unique trademark names were registered for differentiating their comprehensive range from competitors.

THE ACTIONS AND OUTCOMES

With a focus on protecting the unique designs of its products, Sayfa initially engaged Actuate IP on a range of design registration matters. The aim was to obtain protection for the overall look of a number of its products prior to launch and hence obtain an edge over its competitors.

Sayfa also turned its mind to selecting appropriate brand names for these new products. With Sayfa looking for a number of trade marks for its various products, Actuate IP tailored a search strategy specifically for Sayfa.  This involved working closely with Sayfa, understanding its business and educating its key people on choosing strong, distinctive brands.  The end result was a cost-effective trade mark project involving clearance searches for multiple brands across multiple jurisdictions. Once proposed brands were cleared and chosen, trade mark filings and registration followed in Australia and overseas.

Sayfa continues to work with Actuate IP on an ongoing basis across design, trade mark as well as patent matters.  From time to time, Actuate IP assists Sayfa in enforcing its IP rights against infringers. Having a solid IP portfolio in place, Sayfa is in a strong position to protect its investment in developing unique and innovative products.

EXECUTION AND OUTCOMES

With the focus on protecting the unique design concepts of their products, Sayfa Systems initially engaged Actuate IP on design registrations for modular ladders and fall-arrest anchor points.

The principal aim was, prior to launching or showcasing new products, to obtain protection for their overall appearance or innovative features, and to secure a competitive edge in the public domain.

This brief was extended to filing design and/or innovation patent applications in Australia and New Zealand for other products, resulting in successful registration outcomes.

Attention was accordingly directed to assigning appropriate brand names to the product range, for which Actuate IP tailored a specific and cost effective search strategy.

This necessitated working closely with Sayfa Systems, understanding their business objectives, and assisting their key personnel in the choice of strong and distinctive trademarks.

Execution of the project involved comprehensive clearance searches, for multiple brand names in respective classes across multiple jurisdictions.

Trademark applications were then filed with IP authorities in Australia and New Zealand, again resulting in successful registration outcomes.

Actuate IP has on several occasions, successfully overcome objections by the respective IP authorities, defended Sayfa Systems against patent infringement allegations, and enforced their rights against infringers.

Sayfa Systems has retained the exclusive services of Actuate IP,for product range patent and trademark applications in the USA and Canada, by virtue of their expertise and experience in overseas countries.
